ESIGN CONSENT DISCLOSURE AND TERMS OF USE
In this ESIGN Consent Disclosure and Terms of Use (these “Terms of Use”), the words “we,” “us,” and “our” means Regional Finance Corporation of South Carolina, its affiliates, and its parent corporation Regional Management Corp. The words “you” and “your” means the person giving consent to use electronic records and signatures, and agreeing to the Terms of Use. “Transaction” means your application for a loan from us, the closing of the loan if you are approved, and servicing and collection of the loan after closing. “Communications” means each disclosure, notice (including any payment notifications), agreement, undertaking, fee schedule, periodic statement, record, document or other information we provide to you, or that you sign or submit or agree to at our request, in connection with the Transaction. “Signature Service” means the online signing platform we use to present Communications to you and obtain your signature.
ESIGN Consent Disclosure
You have indicated you wish to receive and sign the documents relating to your transaction with us electronically. We are required by law to give you certain information “in writing” – which means you are entitled to receive it on paper. Under the federal E-SIGN Act and related state laws, with your consent, we can deliver certain written disclosures, documents, and information to you electronically and can use electronic signatures in connection with your Transaction. These Terms of Use relate to your use of our services and your Transaction. Please read the terms of these Terms of Use prior to giving your consent, and please maintain a copy of these Terms of Use for your records.
Your Consent. By electronically agreeing to and signing these Terms of Use below, you consent and agree that any of the Communications we provide to you, or that you sign or agree to at our request, may be in electronic form. We may also use electronic signatures and obtain them from you on any Communication. This includes the use of electronic communications, electronic disclosures, electronic disclosures, electronic statements, electronic contracts, and electronic signatures (including “check box” style acknowledgments). By executing these Terms of Use, you are agreeing: (a) to the presentation of electronic documents, agreements, and disclosures; (b) that such documents are binding contracts; and (c) that you will accept and execute the applicable documents electronically. Your further agree as follows:
If you do not agree to proceed with: (a) the signing of agreements electronically; (b) the review of disclosures and statements in electronic format; and (c) the receipt of electronic communications from us, please decline to execute these Terms of Use. If you wish to proceed with your Transaction, you must consent to receiving Communications electronically before we can provide it to you. Your consent permits the general use of electronic transactions and electronic signatures in connection with all your Transactions with us.
Paper Copy of Communications Available Upon Request- No Charge
You may print a copy of the Communications from your computer or emails. If you consent to receive Communications electronically, we will not send you a paper copy of electronic Communications from us, unless you request it or we decide to do so in our discretion. Electronic Communications we present to you will be accessible to you within the Signature Service for so long as we maintain the documents within the Signature Service and for so long as you are allowed access to the Signature Service for the Communications. You may obtain a paper copy of any electronic Communication we provide to you via the Signature Service by printing it yourself. You may also obtain a paper copy of any electronic Communication by requesting that we mail you a paper copy. Requests for paper copies must be made within a reasonable time after we first provided the electronic Communication to you. To request a paper copy, contact us by telephone at 1-888-636-3535. There is no charge associated with requesting a paper copy of a Communication we sent you electronically.
We may always, in our sole discretion, provide you with any Communications on paper, even if you have authorized electronic delivery. Sometimes the law, or our agreement with you, requires you to give us a written notice. You must still provide these notices to us on paper, unless we tell you how to deliver the notice to us electronically.
How to Withdraw Consent. If you decide to withdraw consent before you complete the Transaction, you may do so by exiting the Transaction before you complete it and closing your browser window. You may also withdraw consent within the Signature Service by clicking the “Withdraw Consent” button shown under “More Options” on each page of the Signature Service. You may also withdraw consent by calling us at 1-877-762-8011. If you withdraw consent before the Transaction is complete you will be unable to proceed electronically. You may be required to restart the Transaction via paper, or you may be unable to complete the Transaction at all.
Your withdrawal of consent with respect to the Transaction does not affect either:
How to Update Your Contact Information. If you consent to receive communications electronically, we will contact you at the email address you have provided to us. It is your responsibility to provide us with accurate and complete e-mail address and other contact information, and to maintain and update promptly any changes in this information. You can update your contact information at any time by calling us at 1-888-636-3535.

By “Current Version,” we mean a version of the software that is currently being supported by its publisher. From time to time, we may offer services or features that require that your Internet browser be configured in a particular way, such as permitting the use of JavaScript or cookies. If we detect that your Internet browser is not properly configured, we will provide you with a notice and advice on how to update your configuration. We reserve the right to discontinue support of a Current Version of software if, in our sole opinion, it suffers from a security flaw or other flaw that makes it unsuitable for use with your Transactions.
If our hardware or software requirements change, and that change would create a material risk that you would not be able to access or retain electronic Communications, we will give you notice of the revised hardware or software requirements. You are reaffirming your consent if, after we provide you with you notice of the change, you continue to use the Signature Service or access any other online service we offer to you related to the Transaction.
Retaining copies. We encourage you to print or download for your records a copy of all electronic Communications, as well as this ESIGN Consent disclosure and any other document that is important to you.
Termination/Changes. We reserve the right, in our sole discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.

Communications may be sent electronically by us to you (i) by transmitting the Communication to any email or other electronic address that you provide to us, or (ii) by posting the Communication on a website and sending you a notice to your email or other electronic address telling you that the Communication has been posted, its location, and providing instructions on how to access it. Communications sent electronically to you will be effective when the Communication, or a notice advising of its posting to a website, is sent to your email or other electronic address.
